Alimony, also known as spousal support, is the financial support one spouse pays the other during and after a South Carolina divorce. When a spouse requests alimony in a divorce, it may or may not be granted. The court determines whether an alimony payment shall be ordered based on many factors pertaining to the couple’s marriage and circumstances. Alimony differs from child support in that it is not based on a state-mandated formula. The amount of alimony is left up to the discretion of the court.
If you are seeking alimony or contesting it in a divorce, it is important to work with a qualified divorce attorney who can analyze your financial scene and marital circumstances to determine your options. At the Law Office of Rhett Burney, you will have the benefit of representation from a respected divorce lawyer backed by decades of experience. Alimony in South Carolina
South Carolina has four different types of alimony that may be granted by the court.
These include:
- Permanent periodic alimony. This is generally granted when ongoing support is needed for a financially disadvantaged spouse. It is generally paid every month. It ends when either spouse dies or if the supported spouse remarries or cohabits continuously with a romantic partner. It can also be modified when circumstances change in the future. This is the most common form of alimony.
- Rehabilitative alimony. This type of alimony is ordered to give the supported spouse the financial assistance needed to become self-supporting. It can be used for further education, training, or acquiring job skills that will allow the person to reenter the workplace. Courts determine the duration.
- Lump-sum alimony. The court determines what the sum will be and the paying spouse will make the lump-sum payment or pay it in installments over a set time. This form of alimony cannot be modified and is not terminated through remarriage or changed circumstances.
- Reimbursement alimony. This type of alimony is designed to allow a spouse to recover funds he or she spent on the other spouse’s education or career. For example, if Mrs. A held a full-time job to help finance her husband’s medical school education, payments of this type would reimburse her through a one-time sum or installments.
Courts will look at numerous factors when determining alimony. These can include the length of the marriage, age, and health of the parties, the standard of living achieved during the marriage, the financial resources, earning potential, and work history of each party, marital property, child support, and custody awards in the divorce, marital misconduct on the part of either spouse, tax consequences, and more.
If you need legal help with any aspect of alimony in a pending divorce or a post-divorce situation related to modification or termination, turn to the Law Office of Rhett Burney for knowledgeable and skilled assistance.
