How Does Mediation Work?

Mediation involves a neutral third party, the mediator, who works with you and your spouse through negotiation to resolve contested issues. The process is an informal one in which the mediator uses his or her training and skills to foster constructive communication about the issues and ways in which both sides can come together to form an acceptable agreement. 

Even though you may be required to go through mediation by the court, you are never forced into any agreements you are not comfortable with. Agreements are voluntary and, at no time, are any of your rights waived. If the mediation process fails to bring about resolution, your case will proceed to court.

Generally, both parties sign an agreement to mediate which makes the process confidential and lays out other terms, such as the provision of necessary records or documents, and other legal matters.
